VAFMS (VA Foreign Medical Services) is a private, independent company. It is not affiliated with, sponsored by, authorized by, endorsed by, or in any way officially connected with the U.S. Department of Veterans Affairs (VA), the United States Government, or any of their agencies, programs, or subsidiaries.

Any references to the U.S. Department of Veterans Affairs-including names, programs, benefits, eligibility criteria, or processes-are provided solely for informational purposes and do not imply any official relationship, endorsement, or sponsorship.

VAFMS does not represent itself as the VA and does not act as an agent or representative of the VA.

2. Nature of Services

VAFMS provides independent administrative support and informational assistance to individuals seeking to better understand or navigate VA-related processes.

3. No Professional or Government Advice

Nothing provided by VAFMS constitutes legal, medical, financial, or governmental advice.

VAFMS does not provide legal, financial, or governmental advice. Any medical examination services are limited to evaluation and documentation services and are not a substitute for ongoing care, diagnosis, or treatment by your personal healthcare provider.

Use of VAFMS services does not create any fiduciary, agency, or official representative relationship.

4. Medical Examinations and Evaluation Services

VAFMS may coordinate, facilitate, or administer access to medical examinations, evaluations, or related documentation services.

VAFMS Medical Personnel

Certain examinations and evaluations may be conducted by licensed medical professionals who are employees, contractors, or authorized personnel of VAFMS.
When examinations are performed by VAFMS medical personnel, those professionals exercise their own independent clinical judgment in providing examination services.

Limited Scope of Examination Services

VAFMS may provide or arrange examination services for evaluative, administrative, or documentation purposes.

These services are limited in scope and are not intended to establish an ongoing provider-patient relationship for general medical care, diagnosis, or treatment.

Any examination performed through VAFMS is limited to the specific purpose for which it was scheduled.

No Ongoing Medical Advice or Treatment

Except for the examination itself, VAFMS does not provide ongoing medical advice, continuing care, treatment recommendations, emergency care, or long-term clinical management.

Users should seek independent care from their own licensed healthcare providers for diagnosis, treatment, follow-up care, and medical emergencies.

No Guarantee of Acceptance or Outcome

VAFMS does not guarantee that any examination, report, or documentation will be accepted by the U.S. Department of Veterans Affairs or any other authority, result in eligibility, approval, reimbursement, or benefits, or meet any specific governmental standard or requirement.

All determinations are made solely by the appropriate governing authority.

Limitations of Examination Services

VAFMS does not guarantee that any examination, report, or documentation will satisfy every agency, program, or reviewer requirement.

To the fullest extent permitted by law, VAFMS is not liable for outcomes, benefit determinations, reimbursement decisions, or third-party use or interpretation of examination results.

User Acknowledgment

By participating in any examination or evaluation arranged through VAFMS, you acknowledge and agree that you voluntarily choose to participate, understand the limited purpose of the examination, assume responsibility for how any results are used or submitted, and will seek independent medical care for treatment, follow-up, or emergency needs.

5. No Guarantee of Benefits or Outcomes

VAFMS makes no guarantees of any kind, including but not limited to the following:

  • Eligibility for any VA program or benefit
  • Approval of any claim or reimbursement
  • Payment amounts or reimbursement results
  • Processing times or timelines
  • Success of any submission or request

 

All determinations are made solely by the U.S. Department of Veterans Affairs or other applicable authorities.

6. User Responsibility

By using VAFMS services, you agree to the following:

  • You are solely responsible for the accuracy and completeness of all information you provide
  • You are responsible for complying with all VA rules, requirements, and deadlines
  • You will independently verify important information with official government sources
  • You assume full responsibility for any decisions made based on information provided by VAFMS

7. Third-Party and Government Actions

VAFMS has no control over and assumes no responsibility for the following:

  • Decisions, actions, or delays by the VA or any government agency
  • Errors, outages, or administrative issues within government systems
  • Actions, services, or performance of any third-party providers

8. Disclaimer of Warranties

All services and information are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to accuracy, completeness, reliability, or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, VAFMS and its owners, officers, employees, contractors, affiliates, and partners shall not be liable for any damages, including but not limited to loss of benefits or reimbursement, denied or delayed claims, loss of revenue or opportunities, or any indirect, incidental, or consequential damages arising out of or related to the use of, or inability to use, VAFMS services.

10. Indemnification

You agree to indemnify, defend, and hold harmless VAFMS and its affiliates from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of your use of the services, your violation of these terms, or your submission of inaccurate or misleading information.

11. Acceptable Use

You agree not to:

VAFMS reserves the right to suspend or terminate access at its sole discretion.

Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
